Terms and Conditions
1. Scope
These General Terms and Conditions (GTC) apply to the use of the cocharge platform operated by cocharge GmbH, Bahnhofstr. 37, 28195 Bremen (hereinafter "cocharge").
The GTC govern registration, framework agreements, and use of EV charging infrastructure via the cocharge app and website.
2. Definitions
- Operator: Owner of a charging station who makes it publicly accessible via cocharge
- User: Person who uses a charging station via cocharge
- Charging Point: Individual charging facility at a charging station
- Commercial Operator: Operator with registered office in the European Economic Area (EEA)
3. Contract Conclusion
The contract is concluded through registration and acceptance of these GTC. By registering, the user/operator confirms that all information provided is correct.
4. Obligations of Operators
Operators undertake to:
- Provide correct station data (location, opening hours, access, prices in €/kWh, connector types)
- Properly maintain the station
- Comply with all applicable laws and regulations
- Provide a valid payment method for receiving payouts
- Keep the charging station publicly accessible and non-discriminatory
5. Special Regulations for Commercial Operators
The following additional regulations apply to commercial operators:
- 15 days notice period for changes to the GTC
- 30 days notice period with written justification
6. Obligations of Users
Users undertake to:
- Create an account and provide correct information
- Deposit a valid payment method
- Treat charging stations with care
- Report damage immediately
- Pay the agreed amounts after charging sessions
7. Prices and Billing
The prices for charging sessions are set by the operator and displayed in the app. Billing is based on actual energy consumption in €/kWh.
cocharge retains a service fee of 15% of charging revenues. The operator receives 85% of revenues.
Payouts to operators are made monthly and automatically.
8. Reservations
Users can reserve charging stations up to 48 hours in advance.
- Cancellations up to 3 hours before the scheduled time are free of charge
- Later cancellations may incur fees
9. Liability
cocharge is not liable for:
- Damage caused by improper use of charging stations
- Interruptions in availability
- Actions or omissions of operators or users
The liability of cocharge is limited to intent and gross negligence, insofar as legally permissible.
10. Contract Duration and Termination
The contract is concluded for an indefinite period.
- Users can terminate at any time
- Operators can terminate with 30 days notice
- cocharge can terminate with 30 days notice
The right to extraordinary termination for good cause remains unaffected.
11. Data Protection
The collection and processing of personal data is carried out in accordance with our Privacy Policy.
12. Changes to the GTC
cocharge reserves the right to change these GTC. Changes will be communicated with at least 15 days notice (for commercial operators) before they take effect. In case of non-acceptance, users and operators can terminate the contract.
13. Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
The place of jurisdiction for all disputes is Bremen, insofar as legally permissible.
Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected.
